1. Company Details and Governing Law

All services provided by Prime Potential and MedTech Consulting BV are exclusively governed by Dutch law. Any disputes shall be submitted to the competent court in the district of Noord-Holland, unless mandatory law provides otherwise.

Prime Potential is not a healthcare institution within the meaning of the Dutch Healthcare Quality, Complaints and Disputes Act (Wkkgz) and does not provide regulated healthcare services.

2. Disclaimer — Nature and Purpose of the Assessments

What the assessments are

The Prime Potential assessments are self-help instruments developed for personal and professional development. They are based on publicly available scientific models and frameworks, including the MBTI framework, Goleman's EQ model, Schwartz Values Theory, the Thomas-Kilmann conflict model, the Kobasa Hardiness model, the VIA Character Strengths framework, the Mindful Attention Awareness Scale (MAAS), Ryff's Psychological Well-Being model, and the Spiritual Intelligence framework by Zohar and Marshall.

What the assessments are explicitly not

• Recognised diagnostic instruments in the clinical or regulatory sense
• A substitute for professional psychological, psychiatric, medical or therapeutic advice
• A basis for clinical diagnoses or treatment plans
• A selection tool for recruitment or performance evaluation (such use is expressly prohibited)
• A guarantee of specific personal or professional outcomes

Voluntary participation

Participation is entirely voluntary. Users are free to discontinue at any time. Results are informational in nature and should be interpreted independently by the user in the context of their own situation.

3. Limitation of Liability

MedTech Consulting BV strives to provide reliable, high-quality content, but cannot guarantee the completeness, accuracy or suitability of assessment outcomes for any specific use case.

Exclusion of liability

To the fullest extent permitted under Dutch law, MedTech Consulting BV accepts no liability for:

• Direct or indirect damage resulting from the use of, or reliance on, assessment outcomes
• Decisions — professional, personal, financial or otherwise — based on the results
• Misinterpretation of results by the user
• Technical failures, interruptions or errors in the digital service
• Acts or omissions of third parties, including payment processors and email services

Cap on liability

If liability is established under mandatory Dutch law, it shall at all times be limited to the amount paid by the user for the relevant service, with a maximum of €500 per incident.

4. Mental Health and Crisis Protocol

Intended audience

The assessments are intended for psychologically stable adult professionals seeking insight into their leadership style and personal development. They are not suitable as an intervention for:

• Severe depression, anxiety disorders or other psychiatric conditions
• Active crisis situations, including suicidal thoughts or self-harm
• Situations in which professional care is required or has been recommended

Crisis resources

If you are experiencing a psychological crisis, or having thoughts of suicide or self-harm during or after completing an assessment, please contact one of the following immediately:

Liability regarding mental health outcomes

MedTech Consulting BV accepts no liability for psychological reactions to assessment outcomes, including feelings of distress, frustration, existential unease, or crisis situations that may or may not be related to the results received.

Users who are uncertain about their suitability to participate in self-reflection instruments are expressly advised to consult a registered healthcare professional before proceeding.

• Personal use of assessment outcomes for your own development
• Sharing a reference or link to prime-potential.com

Prohibited without prior written consent

• Reproduction, publication or distribution of questionnaires, profile texts or reports
• Commercial use of any part of the Prime Potential suite
• Use of the assessments as a selection instrument in recruitment or performance review
• Offering the assessments to third parties as your own product or service

Underlying scientific models

The scientific models on which the assessments are based are in the public domain or covered by Creative Commons licences. The specific application, translation into a leadership context, question design and all profile texts are original works by MedTech Consulting BV.

6. Payment Terms and Refund Policy

Pricing and payment

All prices are in euros and inclusive of applicable VAT, unless otherwise stated. Payment is processed via Stripe. Prime Potential does not store payment card details. Stripe's own terms of service govern the payment transaction.

Discount codes

Discount codes for corporate agreements, events or team purchases are personal, non-transferable, and subject to a validity period communicated at issue. Codes are entered at the Stripe checkout step.

Refund policy

Because the assessments are digital products made available immediately upon payment, the right of withdrawal does not apply once access has been granted and the user has expressly consented to this, in accordance with Article 16(m) of the EU Consumer Rights Directive (implemented in Article 6:230p of the Dutch Civil Code).

In the event of a demonstrable technical failure preventing access, Prime Potential will offer a remedy or, at its discretion, a refund. Requests must be submitted to contact@prime-potential.com within 14 days of purchase.

VAT

MedTech Consulting BV is VAT-registered in the Netherlands. EU business customers with a valid VAT number may contact us for invoicing under the reverse-charge mechanism.

7. Privacy Policy and Data Processing

MedTech Consulting BV processes personal data in accordance with the General Data Protection Regulation (GDPR, Regulation EU 2016/679) and the Dutch Implementation Act (UAVG).

Data controller

Data we collect

• First and last name
• Email address
• Job title and organisation (optional, if provided)
• Responses to assessment questions and calculated profile results
• Optional description of your current leadership challenge
• Payment reference (processed by Stripe — we do not receive card details)

Purposes and legal bases

• Performance of contract (Art. 6(1)(b) GDPR): to send assessment access and reports
• Legitimate interest (Art. 6(1)(f) GDPR): to improve services and follow up on business enquiries
• Consent (Art. 6(1)(a) GDPR): to add you to the Prime Potential mailing list, if explicitly given. Withdrawal is possible at any time via the unsubscribe link.

Retention periods

Personal data is retained for as long as necessary for the provision of the service, with a maximum of 3 years after the last interaction, unless a statutory retention period requires otherwise (e.g. 7 years for financial records).

Third parties and data transfers

• EmailJS: email delivery — data processor, data processing agreement in place
• Mailchimp (Intuit Inc.): email marketing — data processor, EU-US transfers based on Standard Contractual Clauses
• Stripe Inc.: payment processing — independent data controller for payment data

Your data is never sold or provided to third parties for commercial purposes.

Your rights

You have the right to access, rectify, erase, restrict, port, and object to processing of your personal data. Requests: contact@prime-potential.com. You also have the right to lodge a complaint with the Dutch Data Protection Authority (autoriteitpersoonsgegevens.nl).

8. Cookies

Prime Potential uses only functional cookies strictly necessary for the operation of the website and assessments. No tracking or advertising cookies are placed. Stripe may place cookies in connection with payment processing, subject to their own cookie policy.
